Terms of service

These Terms and Conditions (“Terms”) govern your use of the website myfoundry.co.uk (the “Site”) and any purchase of products or services made through it. By accessing or using the Site, you agree to be bound by these Terms.

 

1. Definitions and Interpretation

1.1 In these Terms, unless the context otherwise requires:

  • “Company”, “we”, “us”, “our” means Foundry Health Ltd, company number 16530874, registered office at 23 Goswell Road, London, EC1M 7AJ, trading as “Foundry” or “Foundry Health”.
  • “Pharmacy” means ABSM Healthcare Ltd trading as The Independent Pharmacy, company number 08515600, registered at 14–16 Dixon Road, Brislington, Bristol, BS4 5QW, GPhC number 9011543, superintendent pharmacist Mr Andy Boysan (registration 2047716).
  • “Products” means all goods sold via the Site, including prescription-only medicines (POMs), general sales list (GSL) medicines, pharmacy medicines (P), supplements, and any other non-medicinal products.
  • “Services” means all services accessible via the Site, including membership programmes and access to Pharmacy clinical services.
  • “Membership” means any paid plan offered by us, including Forge memberships (e.g. “Shift”), which alter fees or benefits associated with a treatment programme.
  • “Order” means your request to purchase Products or Services from the Site.
  • “Site” means myfoundry.co.uk.
  • “You”, “your” means the person accessing the Site and/or placing an Order.

1.2 References to “including” are deemed to mean “including without limitation”.

1.3 Headings are for convenience only and shall not affect interpretation.

2. Scope of Services

2.1 Foundry Health Ltd operates the Site, provides access to memberships, processes payments, and offers customer support.

2.2 The Pharmacy is solely responsible for:

  • Conducting clinical assessments,
  • Prescribing prescription-only medicines, and
  • Dispensing and dispatching prescription medicines.

2.3 Foundry Health Ltd does not provide medical or pharmaceutical advice. All clinical responsibility rests with the Pharmacy.

3. Eligibility

3.1 The Site is intended for individuals aged 18 or over who are resident in the United Kingdom.

3.2 By placing an Order, you confirm that you meet these eligibility requirements.

4. Orders and Clinical Approval

4.1 Orders for POMs are subject to clinical approval by the Pharmacy. Clinical approval is not guaranteed.

4.2 You must provide full, accurate, and up-to-date information in all medical questionnaires. Any omission or misstatement is your responsibility.

4.3 Prescriptions are for your personal use only and must not be shared, resold, or distributed.

5. Memberships

5.1 Memberships are offered for defined treatment programmes (including Forge memberships such as “Shift”) and run for a 12-month term unless otherwise stated.

5.2 You have a statutory right to cancel your membership within 14 days of purchase under the Consumer Contracts Regulations 2013. If you cancel within this period and have not used any membership benefits, you will receive a full refund. If you cancel within this period after using membership benefits (including waived service fees, discounts, or partner offers/freebies), we will deduct the value of those benefits from any refund. Where the value of benefits used is equal to or greater than the membership fee, no refund will be due.

5.3 After the 14-day period, memberships may be cancelled at any time through your online account. Cancellation will take effect at the end of your current billing period. No refunds are given for the current billing period once it has started.

5.4 Cancellations must be made through your online account. We do not accept cancellations by email, phone, or post.

5.5 If you hold more than one membership under a combined plan, cancellation of one membership will end any combined discount. Remaining memberships will continue at their standard price unless cancelled separately.

5.6 Refunds (where applicable) will only be made to the original payment method.

5.7 Membership benefits apply only to the named account holder. GLP-1 supply is capped at one pen per four-week period, whether on membership or pay-as-you-go.

6. Prices and Payment

6.1 All prices are shown in GBP.

6.2 Payments are processed via Mollie (including debit/credit cards, Apple Pay, and Google Pay where available).

6.3 You confirm that you are authorised to use the chosen payment method.

6.4 We may correct errors in pricing or descriptions. If we cancel an Order after payment, a refund will be issued.

7. Delivery

7.1 Deliveries are made in accordance with our [Delivery Policy], which forms part of these Terms.

7.2 Risk in the Products passes to you upon dispatch to our courier, subject to your statutory rights.

7.3 We are not liable for courier delays, failed delivery attempts, or missed delivery slots once an Order has left our control.

8. Returns and Cancellations

8.1 POMs cannot be cancelled or returned once ordered, except where faulty or not as described, in line with UK law.

8.2 Non-POM goods may be returned in accordance with your statutory rights and our Returns Policy.

9. Your Responsibilities

9.1 You agree to:

  • Provide accurate and complete information at all times,
  • Use Products only as prescribed or directed,
  • Inform your GP of any treatment started via the Site.

9.2 Failure to comply with these obligations may result in refusal of service and/or termination of your account.

10. Intellectual Property

10.1 All content on the Site is owned by us or our licensors.

10.2 You may not copy, reproduce, distribute, or otherwise use any Site content without our prior written consent.

11. Limitations of Liability

11.1 Nothing in these Terms excludes liability for death or personal injury caused by negligence, fraud, or any other liability which cannot be excluded by law.

11.2 Subject to clause 11.1:

  • Foundry Health Ltd is not liable for clinical advice, prescribing decisions, or the supply of POMs. These are the responsibility of the Pharmacy.
  • We are not liable for manufacturer defects, product recalls, or adverse reactions. Claims must be directed to the manufacturer and/or the Pharmacy.
  • We are not liable for losses caused by inaccurate information you provide, misuse of Products, or failure to follow medical advice.
  • We are not liable for indirect or consequential losses, including loss of profit, business, or goodwill.
  • Our total liability for any claim shall not exceed the amount paid by you for the relevant Product or Service.
12. Changes

12.1 We may update these Terms at any time by posting a revised version on the Site.

12.2 Continued use of the Site after changes are posted constitutes acceptance of the revised Terms.

13. Governing Law and Jurisdiction

13.1 These Terms and any dispute arising out of them are governed by the laws of England and Wales.

13.2 The courts of England and Wales have non-exclusive jurisdiction.
